1 A bill to be entitled
2 An act relating to offenses committed while operating a
3 motorcycle; creating s. 316.1926, F.S.; providing
4 additional penalties for certain offenses committed by a
5 person operating or in actual physical control of a
6 motorcycle; requiring that the person be taken into
7 custody; providing for seizure and forfeiture of the
8 motorcycle; providing for revocation of the person's
9 privilege to operate a motorcycle; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Section 316.1926, Florida Statutes, is created
15 to read:
16 316.1926 Motorcycle offenses.--
17 (1) When a law enforcement officer charges a person with
18 reckless driving in violation of s. 316.192 or exceeding the
19 speed limit by 30 miles per hour or more in violation of s.
20 316.183(2), s. 316.187, or s. 316.189 while operating or in
21 actual physical control of a motorcycle, the officer shall
22 arrest the person, take him or her into custody, and seize the
23 motorcycle, which shall be subject to forfeiture under the
24 Florida Contraband Forfeiture Act.
25 (2) Upon conviction, in addition to any other penalty
26 provided by law, the court shall revoke the person's
27 authorization and privilege to operate a motorcycle for a period
28 of 10 years and order the person to surrender his or her
29 driver's license.
30 (a) If the person holds a Class A, Class B, or Class C
31 driver's license, the department shall issue a replacement
32 license, valid for the remainder of the person's unexpired
33 license period, without the endorsement to operate a motorcycle.
34 (b) If the person holds a Class E driver's license that is
35 not restricted to motorcycle operation only, the department
36 shall issue a replacement license, valid for the remainder of
37 the person's unexpired license period, without the authorization
38 to operate a motorcycle.
39 (3) Revocation of the privilege to operate a motorcycle
40 under this section shall not prohibit or restrict the issuance
41 or renewal of a driver's license for purposes other than the
42 operation of a motorcycle.
43 Section 2. This act shall take effect October 1, 2008.

Nice....the gubmit's not happy with just taking your money, now they want your property. Let me guess....some nitwit pol got scared by a big bad motorcyle on the way home from "work" and he came up with this bill. That's about all it takes for these low lifes to come up with something like this. And they know they're won't be a big stink about it. Notice how it was aimed at just motorcyles and not all vehicles.

Politicians are only half a step above child molesters on the food chain. [:'(]

It's not just bikes. They are impounding and selling cars of people caught racing. And this ties directly back to the sport bike guys that tend to run from the cops. I doubt it has anything to do with being scared by a big bad bike on the way home. Next time you see a jackass on a sport bike doing a wheelie at 90+ in a 45mph zone, remember this law.

I guess the moral of the story is Don't Drive Like a Fuching Idiot, and you won't have to worry about it.

My being a person totally against legislating the proper behavior norms of people do not see a possible problem with this law... any idiot that thinks it is OK to totally disregard the safety of his fellow man should run this risk...

They already impound motorcycles here in floridah , all a LEO has to do is witness a rider acting like a jackass and get the plate # Then can go after him later and seize the bike , they press charges then drop them but keep the bike ..

Bikes don't concern me anywhere near the jackasses I see in cars and trucks everyday. We don't need a new law, all we need to do is enforce the ones we have. The roads have become a joke with all the idiots that think they're in a nascar tryout. The ones cutting in front of you at 80 nph and causing 3 hour traffic jams whenthey hit someone. People get caught up on the speed thing. It's not speed that's the problem. I can cruise at 80 all day minding my own business and not putting anyone in harms way. Like I said it's the wreckless driving idiots that are the problem.

Don't need another half azz law, just enforce what we have.

My reference to the idiot pol probably getting scared on the way home was from what just happened here in MA. Some idiotstate rep on his way to "work" saw some kid about 5 on the back of a bike with an adult and decided that this was "insane and irresponsible". Hestarted a bill when he got to "work" tomake it illegal for children under16 to be allowed on the back ofmotorcycles!!More bs from idiots in gubmit thatare either trying to run your life and/or steal your money.

So you think it's OK for the State to take your personal property because you were speeding??? Yes, if you are speeding (30 mph over is pretty fast) then you should be punished and fined, but you have no prob with handing over your brand new $25k Ultra and taking away your motorcycle license for 10 years? This bill doesn't say the state tows your bike, it says they TAKE your bike.

What happens to those car drivers in Florida who are caught going 30 mph over? Do they forfeit their car and give up their driver's license for 10 years???

The real moral of this story is you better call your state reps and tell them to vote "NO" on this discrimantory bill!!!
