WOW.

I'm sympathetic and empathetic but the $287MM just seems a bit ludicrous.

The corporation will have insurance that will pay for this, or at least most of it.

2019 was the first year with TC/RDRS.

Dollar to a donut hole it will be reduced or overturned on appeal- RDRS/TC is not a "guarantee to not wreck", no matter how badly the local jury wants to help the local guy.

Just curious on what the plaintiff attorney's fee will be.

2019 Tri-Glide has traction control. However, there was a safety recall and a software update along with some sort of brake switch/electronic update to the stop light switch.

It would be interesting to see the timing of the recall notice, whether the victim was notified, and the accident. And how it was determined this was the cause of the crash.

The recall description looks bad:
”To inform dealers of a safety recall for 2019-2020 Trikes with traction control, refer to Table 1. The Trike may respond incorrectly to a faulty rear WSS (Wheel Speed Sensor) signal by activating one of the rear brakes. Unintended activation of one rear brake could lead to an unexpected change in the vehicle direction which may increase the risk of a crash”.

They probably took the case on contingency, which is usually 33%-40%.

Since the survivor doesn’t remember anything about the accident, I wonder how anyone would know if one of the rear brakes locked up and the bike was under a recall?
