Looking at history - The insurance value is MAYBE 3 million, 5 million on a bad day. The attorney put his foot in his mouth when he said small town justice. No doubt they had a 'Bronx Jury'. Trust me, this will hit appeal and win just from that statement.
There's 3 faults here
a. Mothership having the issue
b. Dealer doing a prior repair that was most likely not done correct because they couldnt recreate it.
c. Did the owner of the bike have all needed recalls completed

This was 1 bike, there was no intent, was there a recall that wasnt done. I used to do litigation support for one of the largest high-end insurers on earth.

Tragic - yes
Worth money - yes
287m - NFW

I'll bet a ham sandwich they will claim Bronx Jury and win an extremely reduced settlement. So what is a Bronx Jury - It's a local jury that no matter what they will give insane settlements or non-guilty verdicts because the litigant was local.

I’m sorry this happened , and condolences to all. But, **** happens.. If this wasn’t due to a systemic design or manufacturing issue, I don’t understand how the MoCo can be at fault. What if a properly installed, and properly lubricated wheel bearing failed and caused an accident? So, anytime a failure causes an accident, you can sue for damages…What if a hidden stress crack was in a lift bracket, and it eventually broke causing an accident? Is that manufacturer responsible? Would negligence or malice need to be proven?

I was a product development engineer, and worked for a major corporation. Product liability is in reason I didn’t go out on my own on many of the ideas I’ve had,

No it won't. Motions to appeal will be filed, it'll, get dragged out over several years and all parties will finally end up settling for a third of that.

If the case was taken on contingency, 33% includes that. There may be a rider for x-amt but I doubt its over 10k
