I called my corporate attorney and he sent me over to a firm he highly recommends for personal injury. I've already had several phone conversations with the managing partner, and he is sending an associate over on Monday. I never thought I would be suing anyone either, but there is too much at risk - my injuries being in the forefront. If I can't lift my arm up level with my shoulder without it popping out, I'm in trouble for the rest of my life.
And that scares me!

......first off..HOLY F*CK man...you are one lucky dude to have such small injuries...thank God for that...

Second...I can't believe how much bogus info gets thrown around here every time someone crashes and starts a thread about insurance coverage..I'm a MA state licensed auto damage appraiser, employed by a major insurance company here.

the facts: there is no law about totaling a vehicle with percentages..an ins company can do WHATEVER it wants about totaling a vehicle..I total some at 40%!! If we don't want to fix it...we total it..period

frame replacement is NO BIG DEAL...do it all the time in this business

GET A LAWYER...you will have aches and pains ten years from now when rain's coming..you need to get some dough for that..

good luck and speedy recovery...

I'm glad you are consulting an attorney. I'm not prone to using them, but your case sounds like it's appropriate to have one.

Don't underestimate the possible long-term effects of an injury. I still have lower back issues from getting rear-ended (in a cage) in 1985, and I wasn't even hospitalized after that accident. Your lawyer will help assure you are well taken care of - appropriately.

Thinking that diminished value for a wrecked bike that has been repaired, should be a major consideration.

Respectfully, you're incorrect. MA has no legal threshold, MD does. You can see this here.

The important thing is that the OP is OK, and he's done the smart thing by getting a lawyer.

Here's how it works here in beautiful Southern California:

The idiot that pulled out in front of you is an Illegal Alien with no insurance and no driver's license.

He takes off, leaving the scene of the accident and makes a straight beeline for the Border never to be found !

You have no one to go after in court or for insurance settlement. Your insurance company pays for damages. Be glad you don't live in la-la Land !

Glad you are not even more injured. I've had both rotator cuffs repaired, it hurts, and off work 5-6 weeks each time. Good news is my shoulders work fine, unless I sleep with my arms above me. Looks like the crash bar did its job. Hope you get total value.
