Glad you weren't hurt. You'll spend more on an under-employed lawyer on that occurrence than you even slightly have a chance of recovering. Your State's Small Claims court system (if there is one there) might be a route to look into.

Glad to hear you were not seriously injured. Bike mods are the owners liability along with the operation of the bike. I don;t believe you have any grounds against the MOCO. You might against the dealer who performed work. The work should have been thoroughly tested, either by road test or Dyno performance through the power band in all gears. Too many internal engine parts cause a power loss to nail it down over the net. I have not heard or known of any problems you discribe.

You probably limited the MOCO's liability the minute you installed the aftermarket parts.

I don't believe the crash was my fault.
It was the dealers.
When you take it in for repairs to a dealer you expect repairs to be done right.
The dyno says power and torque is there. The service manager says the bike is done.
You put approximately 200 mph on the bike after repair for break-in.
It feels and acts right.
Then you do a below speed limit pass (65mph)of another vehicle, and the problem comes
back, but this time worse than before!
This is not rider error!
Now for some reason andI don't know why:
My original post asked for HELP, in the way of other riders that HAVE EXPERIENCED this type
of problem LOSS OF POWER AT HIGHWAY SPEEDS, not these B.S. answers you've been giving me.
If you can NOT provide positive information of type requested, then don't respond to the post!
i know that you think you might have a case, but i think you might oughta listen to some of these bs answers, there may be a ring of truth to them. and not to step on your toes or nothing, but you might have limited any possible replies that you might have gotten in your favor with your smart *** attitude (at least thats how the above post came across to me) if you didn't like what someone replied, scroll on past it.....

The dealer was not operating your bike nor did the dealer encourage you to attempt the pass. You should always give yourself an "out" or a fallback plan.

The only time I have ever had issues with loss of power or "coughing" when attempting to accellerate were on a carburated Twin Cam in the rain when the air filter got saturated. A couple of revs of the engine cleared it right out. But the first time it happened I went "WTF???"

Have the dealer get the MOCO on the phone. The MOCO techs would probably want to know of this issue. You might get a replacement engine if the unit is still under warranty. But I doubt you will get the damage from eating the ditch covered by anything other than your insurance company.

Ok What is MOCO I assume the factory techs, but please spell out what moco is abbreviated from.

Personally if you are going into a head wind and uphill like you stated at 65 in 5th gear you are not going to be accelerating ANYWHERE. Youll need to down shift into 4th.

As for the wreck. 100% your fault. No one would be coming up so fast that they cannot stop. If they were you shouldnt be cutting cars off.....

i stand by my first statment.
