I've got an 09 and it's no cats, unless it's a californicate model.

 

09 was last year before EPA mandate so your're good (no CAT) & it's located in the header pipe - heat exchange (see pic).

 

If you take off your right muffler you would be able to easily see it if you had one if you wanted to be 100% sure, but I believe that '09's didn't have them.

Only California bikes had a CAT in 2009. In 2010 all of them do.

The CAT is in the collector where the two headers come together, not in the mufflers.

 

you would know by the lack of sound on the bike. you would sound more like a vespa. Mine use to have a cat but she ran away.

 

Brazilian assembled 2009 bikes also have cats. Mine is a FLHTC and it has a cat in header.
