The instructions show that the fender tip light is removed and replaced with a piece of chrome trim. This accomplishes two things: (1) removing the fender tip light electrical connection from the tail light circuit board frees that location for the license plate LED electrical connnection in the kit; and (2) avoids interference with the fender tip light with the license plate bracket mounted below the tail light using the kit's license plate bracket.
The chrome trim piece that replaces the fender tip light on the older models is too narrow to work on the wider '09 and newer rear fender. Can't say that's "why" HD says the kit won't fit an '09 or newer bike, but the difference in the fender width will certainly prevent use of that chrome trim piece on the wider '09 and newer models.

Why not go the other more cost effective way, fit the HD bullet turn signals (Front & Rear approx $130) and a narrow rear turn signal bar?
That's what I did and I am very happy with the look, stops my RK looking like a Street Glide but still makes it that little bit different from the norm

I installed the H-D bullet rear turn signals (68615-04) and, to move the license under the tail light, I installed a license relocator from Lazer Star (Drag Specialties part #19050000). It's a little pricey - $47.96 from M&Ms - but it was easier than my first plan to build my own.
Canadian license plates are bigger than US plates so you can see in the attached picture there shouldn't be any problem with the fender ligths.

I ordered a curved plate holder from Kuryakyn when I started blinging out the RKC. When it arrived I realized our plate sizes were different than the US and I had just wasted a gob of money. I thought I could still use it if I trimmed the plate down a bit, but I came to the conclusion the coppers would probably have something to say about a missing number on the plate. <G>
