Red face Throttle surge at 2K-23K RPMS Need Advice

Ok...Posted this a couple of weeks ago and got little to no response. I really need your help. Took it to the dealer and they state they can't make it happen...I rode it home and could make it happen over and over. Not surprising. However, I need advice as to what could be causing it. It seems like a throttle position issue. It happens in gears 3-4 when I am riding at 35 and 45 MPH. When I put the throttle at this point and the RPM's are at 2K-2300 it surges forward and then stops, then surges again. Could it be a throttle Position sensor? or could it be a throttle body sensor? Could it be a speed sensor? I am looking for someplace to start so I can give the dealership a CLUE to look at.
Your help is greatly appreciate...and please...drive faster is not the answer I am looking for.

Just a stage 1 download that came with my V&H slipons and K&N filter. Has been running perfect. Let batter run down the other day when lights left on. Jumper her off and she ran fine. Also placed battery tender on her and let battery charge. She has been doing fine ever since except for this irritating surge thing. Any ideas?

The surge is usually a sign that it needs tuned. Does your bike have O2 sensors? I wonder if one of those could be bad? Has it done it since the stage one flash or is it something that started later on?

You may need to have the download redone, it may be possible when the battery weakened and then it was jumped off the surge may have messed the tune up. Otherwise you need a tune to smoothe out the surge.
