In Florida the EMS or Paramedics would have drawn the blood not the police. The police can order it, but wouldn't draw it.

The whole thing stinks! Every LEO on that department knew that in order to comply with the law, and have the evidence admissible into court, that the blood had to be drawn by a particular person. They chose not to do that, for obvious reasons, departmental SOP notwithstanding. The SOP falls below the state statute in the order of precedence. The argument that no one had any indication that the officer was intoxicated is garbage, too. Documentation can readily be found that they have suspected other impaired motorists due to the presence of indicators that they had been trained to look for. So, they either did not see these indicators in every previous case, and lied about it, or they did see the indicators in the LEO, yet did nothing about it, because they wanted to protect a fellow LEO.

Long and short of it is, a drunk on duty, and behind the wheel cop killed a innocent biker, and wounded two others, and then his department immediately began a cover up. I am sure that the LEO is currently out on bond, and has his full driving privileges intact. What's worse is that he is probably on paid leave pending the outcome of the case, and he is still a alcoholic, only now he is a alcoholic with his whole world crashing down around him. Anyone willing to take bets that he is drinking and driving even more now than before, and that someone else will get hurt or die before he goes to trial?

several of the High ranking LEO's on scene have been busted down in ranks - its a shame this happened and a LOT of people will (and should be) punished for this. I can only imagine what the families will end up doing... I know what I would do if it were my wife.
