If the legal limit is .08, you have to start from there, yes .08 x 2 is .16 however you are starting from .08 not .00, so .16 is 1x the legal limit, the legal limit being .08

Perhaps you mean to say that .16 is 100% OVER the limit?

At least we stopped talking about the cop. Actually I use to be a road cop and that was a question I was asked by a defense attorney on the stand. Everyone knows .16 is twice the limit and .24 is three times the limit. I came across a college kid once who was .30, he was walking and talking, no bubbles no troubles...or so he thought.
We had a deputy hit by a woman at leaving lunch one day, she blew a .44 and that was at lunch

I think that the media is forgetting to report one part of this story. The officers working the scene drew the blood under color of the department SOP which does not make the same distinction that state law makes. This makes the blood draw inadmissible in a criminal trial for both reasons, the reason of the draw and where/by whom it was drawn. Legally, it is pretty cut and dry. It still sucks, but that is why it is unfolding the way it is.
