Date: July 27, 2009 - July 7,2009 FLHTCU was towed into San Jose Harley due to
Factory error - Broken weld on frame , FLHTCU has been at
San Jose Harley for 20 days and Counting.

Major Parts Replaced to date: Frame , Swing Arm , Gas Tank
Pending Major Parts to be Replaced: Both Rear Shocks
Pending Non-Major Parts: Heat Shields

MY REQUEST – A New 2009 FLHTCU , with my over $ 2,000.00 factory Harley Davidson Parts, (Reinhart slip on’s and stage 1 with chrome backing – purchased at time of buying FLHTCU).

If my above request is NOT an Option:

MY REQUEST # 2 - July and August 2009 Payments to be put on the back end of the Harley Loan , My bike to be returned to me in Factory Showroom Condition , No Later than 7.29.2009 , A letter from Harley Davidson Motor Co. - No Later than 7.28.2009

Harley Loan Account Number:

In the letter, fully acknowledging and supporting San Jose Harley in Disassembling and Reassembling FLHTCU - VIN# 1HD1FC4369Y650232. In the letter it needs to state that in the event San Jose Harley should change ownership or go out of business that Harley Davidson Motor Co. will assume all warranty and liability as out lined in Harley Davidson Motor Co. 2 year factory warranty. For the parts being replaced: Frame , Swing Arm and Rear Shocks: I would like to see in the letter a statement that Harley Davidson Motor Co. will extended the factory 2 year warranty from the date I pick up the bike.

I don't see anything wrong with writing the letter, but just the way things seemed to go for you last time around here, I'm simply amazed you posted something about it again.

I never thought I'd see more of this again, especially after the last go round. But, what can it hurt to ask? Just don't be surprised by the response.

I agree with Solorider, I'd be a little more "pissy", your actually very factual, to the point, and pretty good at hiding any emotion. Well done letter!

you were so happy with san jose that you didn't even want to state what they did extra to make you happy, go back to them and whine you already dissed the forum members last go around.

Yeah, you're probably asking for too much. Unless California's Lemon Law applies to motorcycles I doubt you'll get a new bike.

Moving your July/August payments to the back of the loan only complicates issues, & they may add interest because of the extra time on the loan.

Harley is the entity guarantying the warranty. San Jose Harley only acts as their agent. You can have the repairs done anywhere & Harley pays. A separate letter won't change any of those things. You probably won't get another full two year warranty on the frame, swing arm, & shocks because warranties don't work that way. They guaranteed to repair any defects for a period of two years, & that's what they are doing.

I'm guessing that you would be better served by asking that they have a local factory representative look at the repairs done by the shop or find a shop that they know is competent.

I know it's a pain, but good luck.

I guess I'd first have to know if they have given you a loaner bike to ride during the repair.
If they have then I think you are being unreasonable. If they haven't given you a loaner bike then by all means go for it.
