You're right about 5th being straight cut. First is also straight cut, due to the gear being stronger. There is zero side load with a straight cut gear, which contributes to less wear as well as less chance of breaking, less heat, and less power loss. The other gears are helical cut due to EPA noise testing. The EPA test varies by state, however it's measured by second, third, fourth, or top gear. Since fifth isn't the top gear anymore, it isn't subjected to noise testing.

The 5th gear/gearing has straight cut teeth as apposed to all the other gears that have a bevel at the end of each tooth that allows a smoother mesh to the adjoining gears...now if you can tell me why R & D did this at HD I would be much appreciative. However, no worries about the wine we all have it on factory 07's and newer...and I have no problem with it and I like it.
