I have heard of this happening, at Mike in DEl tech wiped out a bike for service. new bike was waiting for customer and tech was on medical leave for a while

Actually, it is only mis-called an "accident."
The term is traffic collision.
Calling a "collision" an&nbsp\\;\\\\\\;"accident" implies that it was just some sad unfortunate circumstance that fell down from fate itself. That is not the case. Someone, somewhere f'd up, made a mistake and caused it.

That is how it is termed in law enforcement, in the medical field, and in reality.

It is important that people understand the importance of taking responsibility for their actions. Terming collisions or "crashes", "accidents" implies that no one is at fault. That is simply not the case.&nbsp\\;\\\\\\;&nbsp\\;\\\\\\;

It may sound like i am being a *** about this, and maybe I am\\\\\\; but if you have been treating people that are victims of these "accidents" for as long as I have,&nbsp\\;\\\\\\;you might&nbsp\\;\\\\\\;view traffic collisions differently.&nbsp\\;\\\\\\;

The OP never stated that there was a "collision" with anything other than the ground.&nbsp\\; He stated that the dealer wrecked the bike.&nbsp\\; Then with that vast amount of info people suggested either lawyering up and or demanding a new bike.&nbsp\\;

There are several definitions of the term accident so lets not be quick to "imply" that previous posters are not using the proper terms.&nbsp\\;Unless you were at the scene based on the&nbsp\\;non exisitent information&nbsp\\;given it's amazing that&nbsp\\;figured out what happend&nbsp\\;&nbsp\\;

I know first hand what you feel like,probally alot of your thoughts concerning how bad is it really damaged as well.

I took my bike in for a stator &amp\\;\\\\\\; rotor change to my dealer,told me it would be ready the next day,two days later i called asking about it,the reply was" we were just going to call you"&nbsp\\;\\\\\\; I was told my bike fell&nbsp\\;\\\\\\;while doing service repair to it&nbsp\\;\\\\\\;and landed on a metal work bench,still attached to the service lift,I was crazy pissed! the dealer stayed late till i could get there after work,when i saw my bike all smashed and taken apart so much,i was even more mad,they told me it looked worse than it was,and that they had already spent a entire day going over the entire bike to find any and all damage to it,thus why i got no call the next day ,like promised.
I walked out of the dealership twice i was so pissed and ready to kill someone,called the ole lady to let her know how bad it was and she gave me this advice" keep your cool" you want it fixed right,not just thrown back together and out the door,in other words dont be a a$$hole to them.
well.............. I took that advice from the wife, the bike had $1500.00 worth of damage to it(dealer cost for parts,not retail) .the owner of the dealership told me flat out,as long as i own the bike ,they will stand behind any and all trouble with any problems that might come up from this happening,and told me to look over the bike with the head service guy and tell him what marks on the bike were new or old,I basically said replace the entire side of the bike"everything", no questions asked,and they did just that!&nbsp\\;\\\\\\; By being decent about the whole thing it has come back to me 1,000 time plus in my favor,I'm very respected for the way i handled things and always taken care of whether i have a appointment or not,they take very good care of me! I did step up and take the whole thing one step higher,I asked to speak with the master HD tech who dropped the bike,he was very uncomfortable meeting me after dropping my bike,and told me it was the first one he had ever dropped in 25 yrs,also that he tried to hold it up as it went over ,but just couldnt hold it until the others came running over to assist him,had to let it go or be crushed by it. I shook the guys hand,told him no hard feelings and my bike could go on his lift "anytime" it was in for service! Not one person at the dealership expected me to do this ,I gained alot of respect for stepping up and letting the tech know it was all cool.
I've never had a single problem with my bike because of it being dropped,everything and more was replaced and it looked just like new when i got it back. My dealer is A+ as far as im concerned,and im always treated right,never jerked around

guess you have to decide if you like your dealer enough to trust they will treat you right on this,or if you have already decided you'll go else where from now on,make your decision on that ,as to what you want or expect from them.

I've stood inline at the service desk,seen plenty of a$$holes give the service guys crap,I personally never wanted to be "that" guy,and i'm glad i handled my bikes accident just the way i did,not a single regret!

you didn't bring in a new bike.... you're NOT going to get a new bike out of the dealer.&nbsp\\; You didn't list the damage, so it's hard to say what is fair. I agree with some of the above..
1) get a FREE loaner( that is the dealers tough luck)
2) get another dealer to inspect the damage and make an estimate
3) and this is the part that really sucks, if the bike is written off.... you are only going to get wholesale value for the bike, unless you have direct replacement insurance....

Happened to me a little over a year ago. Took my screamin eagle V-rod in for a new back tire and the "tech" totaled it out on a test ride. It took 4 months for them to make it rideable and still had parts waiting on backorder. I finally had enough and told them I did NOT want a wrecked bike because it wouldn't be worth the same amount. They finally swapped me into a new Road glide.

Long story short, I would not take back a wrecked bike. I would also get a loaner bike until they make it right.
