If they are going to fix it, I would make them give you a loaner of your choice.. Like you said Sturgis is only weeks away, not to mention the 105th in Milwaukee, free loaner, with no record of miles... I mean lets be realistic if you rented a bike from them and it went down you would be paying bigtime for that mistake.&nbsp\\; I tell you, if it were my bike, I might not care if the tech was ok.. That would really and I mean REALLY frost me...

did you own the bike or was it financed?&nbsp\\; If financed the dealer will avoid dealing with you and go with the leinholder
(since they "own" the bike)&nbsp\\; keep in mind that bike will soon be 2 model years old and since there were changes made in 08 it is not reasonable to "demand" a new bike.&nbsp\\; loaners are usually out&nbsp\\; of the question since motorcycles are considered recreational vehicles and since a settelment might last weeks no dealership will give you one of their rental bikes (assuming they have them).&nbsp\\;

You stated that the bike was brought in for a "minor" issue- stalling. Would the bike stall at a light or would you be riding down the road and the motor die?&nbsp\\; was the bike wrecked during the diagnosis or after repair then the final test run?&nbsp\\;&nbsp\\; What caused the wreck??????&nbsp\\; That might have some&nbsp\\;bearing on the dealer's issue. &nbsp\\;&nbsp\\;

Start wheeling and dealing with the dealer...tell him that you would like to "trade the bike" (in its pre wreck condition)(using an agreed upon value between the two of you)on a new one.&nbsp\\;\\\\\\; He sells you a new bike at his cost.&nbsp\\;\\\\\\; You pay the differance between&nbsp\\;\\\\\\;the o7 and the 08(or 09).&nbsp\\;\\\\\\; Dealer does what he want with the wreck.&nbsp\\;\\\\\\; The dealer eats all the fees and set up and throws in a bunch of goodies.&nbsp\\;\\\\\\; He keeps from claiming it on his insurance saving him a possible boost in rates.&nbsp\\;\\\\\\; You get a new bike...Just sayin, might be worth a shot to work with them on something like this.

Man, I know you are upset and alot is running through your head right now.&nbsp\\; We love our Harleys and when this happens it hurts bad.

Give the Dealer a chance.&nbsp\\; Listen to what they have to say.&nbsp\\; I'm sure they feel like s**t over this, especially the tech that got in the accident (I hope he/she is ok).

I've owned chevys, fords, dodge, mercedes, lexus, jaguar and I have to say that Harley-Davidson service shops are a notch above&nbsp\\;at taking care of customers.&nbsp\\; At my dealer, Myers-Duren HD (Tulsa), I've seen the chief Service Manager and his techs, out in 100+ degree heat, off the clock on a Sunday, late afternoon, fixing up bikes on the spot for those passing through on long trips.

Give them a chance and be reasonable.&nbsp\\; There is nothing on your baby that can't be made brand new again.&nbsp\\;

I agree with scoobs route, this may be the best you can get.&nbsp\\; You obviously don't want the wrecked bike back, you don't know what all hidden damage is luking in it and when its going to surface and then you have no recourse in holding them accountable.&nbsp\\;

I'd need to know how much damage the bike had before rendering an opinion.

Any damage to the forks, frame, or swing arm.. no way I am taking the bike back repaired or not.

I'd be wanting a new bike. The dealer can fix and sell your old one and deal with the headaches. They can give you a new bike AND eat any fees involved in the registration of the new one with the $ they get from THEIR insurance. Remember they only have to pay what HD charges them for the new bike so there is a few grand in profit they can eat. Don't think in M.S.P., think invoice less holdback.

There is also a loss you have incurred called "diminished value". A crashed bike isn't worth as much as a non crashed one. If you go to sell a previously crashed bike you know people will not pay you as much for it as they would if it was not previously damaged. Add that "diminished value" loss to the damage to the bike and they would be wise to get you a new ride. If the insurance company insists on fixing the bike, regardless of the amount of damage you want a couple of grand CASH MONEY to compensate you for the lower actual cash value of the repaired bike due to it having been repaired and consequently now and in the future worth less a comparable non crashed bike.

Then there is the "good will" value.. If the dealer screws you, and you park the bike on the street in front of the dealer and walk around on the sidewalk with a big sign telling every potential customer " Joe Blow HD totaled my bike on me! Ask me how" the intangible cost to them would be in the tens of thousands of dollars, if not hundreds of thousands of dollars in lost sales/profit. Post the dealers name on this board and see how long the stink will hover around them. It is in their best interests to keep you happy, and make sure they know that but in a nice way.

I agree with unweldit. Your upset but just don't fly off the handle at the dealer.&nbsp\\;Have faith he'll do the right thing first. Is the mechanic OK. Unforntunately I think his well being is&nbsp\\;more important.&nbsp\\;I not deminishing your problem at all its just people come first in my book. I pray all will be made made well for you.&nbsp\\;

Neggy hit it right on the head. Try to work sumthin out,but if not satisfied,then bad press is a real hit in the
pocketbook. They should kiss ur *** to make u happy.
How could anyone trust them if they screw u????
There are all kinds of arguments they r probably gonna
try on u.EXPECT THE WORST AND HOPE FOR THE BEST!!

I had the same thing happen on Monday afternoon, Remeber that a person was on it and his life is worth more than your bike, You can always get a new ride. Be patient with them and talk with them. Yelling is negitive, and makes things worse. I have a great relationship with my dealer, &amp\\; I hope the guy who got hurt on my ride is recovering. He is HUMAN and EVERYONE makes mistakes.&nbsp\\; I am sure that the dealer will get you bike fixed to the way it was if not better. Like I said be patient&nbsp\\;&amp\\; I am sure all good will come out of this. I have plans to attend the NY state rally but I don't think my ultra will be able to ride there. I have the king but the wife is spoiled&nbsp\\;now and is disapointed we won't have my ultra. One of my friends has offered his NEW 08 Anniversary&nbsp\\;screaming eagle&nbsp\\; ultra to take up north. I am blessed to have such good friends and have a different light on life and it's miss-happs. Le t me know how&nbsp\\;you make out with the dealer .&nbsp\\;

Important, if they fix the bike, have a third party check the repairs......frame, etc...make sure that you were not screwed.
