the stuck throttle could happen on any of the 08's but they have recalled them for safety --

I read somewhere that they think the problem is caused by revving the engine on shut down and what ever the speed is at the time the key is turned off

Tell them you'll sign a release that they aren't responsible for any malfunctions while they wait for parts. If that doesn't work call the police and tell them it's been stolen and you know where it is.

I know it is frustrating for them to have your bike, but if you want it fixed correctly, you almost have to let them have it. Aggravating, yes, right thing for the MOCO to do, yes. Just as others have said, at this point, it is a liability issue. Even if you did sign a waiver, it would be very bad press for the MOCO.

First off, I'm not a lawyer, I don't even play one on TV, but I know a guy....... Without having researched the legalities, I'd bet there's more than ample precedent for the MoCo to take the steps (seizing your bike) they have as it is a liability issue, BUT, since you own the bike I'm also sure that they are liable to provide you with a satisfactory alternative, such as a loaner (and not a Vespa!) until the problem is resolved, at no cost to you. I would definetely start by asking for a loaner; then demanding a loaner. I'm all for "giving the MoCo a break" but by the same token they need to step up when required and look out for the folks that provide their existence. Learned long ago, there is no right way to do a wrong thing....

Well How did it go.. Did you get the loaner??

You shouldn't have to pay for any shipping etc. Harley service usually sucks.. We have a bunch of parts swappers here..
There is a fix for the high idle on start issue.. it has been talked about here on the forum and is in your manual. Something like turn your kill switch of and on 4 times letting the bike cycle trru engine check or something. I have not had any issues with mine but have a fiend that did.. Good Luck and don't let HD service walk all over you..!!

I really don't want a loaner. I just want my own bike back. I have other fun stuff to drive, it's just the point that they are not willing to move any faster than a snails pace to get me my bike back.
They still have it with no end in sight. The service manager keeps calling Harley and leaving messages because tech support is too "busy". Of course nobody calls back.
They're just not doing anything to expedite this at all. It sucks.
I bought the bike 2 months ago and this is it's 4th week in the shop. (Including 2 weeks to install the 103 kit at the original dealer)
Last weekend was a holiday weekend and I had no bike.
This weekend we planned on riding up the coast to Pismo Beach and it looks like I'll be driving instead. This sucks!
The good news is that I got my new seat today. Unfortunately, I don't have a bike to put it on!

bummer,

I got two bikes just so bad karma stuff like don't keep me from riding. Moco should be providing a loaner at no cost to you, or the dealer.
