Default Rear shock mount problem

08 FLHT the top left rear mount is welded on the frame at about a 5* angle and the shock is in a bind, dealer says new frame and I agree. waiting on MOCO to give us an answer. what say you ?

This 5* pushes the shock in about 1/2 an inch at the bottom mount, that can't be good. anyone heard of this before ?

If it is only 5* it sounds like a job for earnie la torch - a little heat and bend. I'd rather have that then a comlete frame swap by a kid that was askin "if I wanted fries with that" last summer.
