for damages...from some hopped up biker lawyer...
wheres the justice in that,,, shouldnt your be responsible
once you get on the bike.? i been riding 34 years...
2nd accident other one was 4 legged variety ..deer..
one bike 2002 RG..... 64,000...miles (one bike)
btw i missed the girl i cant take some one out ,no matter how
stupid they are,,, .....passenger head injurys,,, not good...
a few stictches and some head trauma.....me
2 broken bones 14 screws and 28 stictches... riding now at
7 weeks... a f ew miles a day,....
whatdya think of that i aint taking no one for a free ride no more...!

I stick to riding with my daughters and wife on rare occasion, none of themwould sue me. I wont haul anyone but my family.

Someone you knew real well, or just someone you gave a ride to? Sounds typical to me....passengers in accidents sue the driver in a lot of crashes. If you want to hear something messed up, here's a scenario for ya that is going on right now in my town.....older couple that had been married for several years get into an accident because he ran a stop sign and got sideswiped, both he and her die. The kids are suing his estate on behalf of her estate to collect $1million wrongful death insurance money.

 

Are they (passenger & lawyer) suing you or your insurance company? If they are going after your insurance company I wouldn't worry about it too much; that's why we carry insurance. Were you able to get the information on the girl you almost hit? If you did, I would be going after her or her parents for being the primarycause of the accident. I'm not one of those "let's sue everyone" types but you gotta look out for yourself. Another thing you may want to consider: try countersuing your passenger. File a suit against her as being the cause of the accident (you know, she leaned the wrong way or something and made you lose control). Why not? What's good for the goose is good for the gander, right? Maybe that'll give her and her lawyer something to think about.

I like what mtpoland said. State that the added weight of the passenger made the reaction of the bike less responsive. If it is a chick, basically calling her 'fat' will tick her off, LOL. Sorry about your misfortune, hope it gets settled. I can't believe someone would sue you over that, but there are @ssholes everywhere, I guess.

 

Let the insurance company handle it, thats why i pay for it. Whoever was on there must not have been much of a friend. Its natural to look after your best interests, i am sure they only want the cost of medical bills to be covered right? yeah right! They probably saw the add inA/I with the big name moto lawdogs and punched a few buttons and got the cash cash cash fever. sorry to hear about this, i hope it works out.
But the bottom line is everyone is alive, thats all that really matters.
