HD Super Tuners issue
So the EPA went after HD about the Super Tuners and HD has agreed to pay $12MM.
What I'm wondering is, why aren't all tuners illegal? Is Dynojet and all other manufacturers of tuners next? Why focus solely on the HD Super Tuners.
I don't recall reading anything about why the focus is on those tuners in particular.

Devices like the Power Vision or FP3 or others arent inherently illegal, you can certainly create EPA friendly tunes with these devices.
I personally think that in order to avoid liability HD will make it very difficult/impossibe to access the ECM on the grounds that it is their intellectual property. (other manufacturers are on a path to do just that, examples are John Deere and GM)
Then you'll be left with ECM replacement products, but I cant imagine that those have a long life either. Because those manufacturers (unless they limit the replacment devices to only EPA compliant boundaries) are not going to base their businesses on selling things that are illegal

So those of us who modify our bikes will become like people who jailbreak their phones

Its a computer. Very easy to make it difficult to break in to. But easy or difficult is not really the point. We are moving to an era where it is illegal to do this. Individual people may find ways to get in to modify, (like jailbreaking your phone), but companies will not sell products that are illegal, so eventually none will be offered by commercial vendors who have an incentive to make their products easy, etc.
