I suspect there will be a way for them to know if it has been tuned, despite having a 'factory tune' on it. Some car makers can now tell. Have a friend with a Mustang that had his warranty voided despite having failed back to the factory tune before taking it in.

The warranty can't be "voided" regardless of what you do to the bike. A warranty "claim" certainly CAN be denied if the manufacturer determines that an unauthorized change to their product was a contributing factor in the failure that is being claimed.

In other words, changing the map or the exhaust or the heads and anything else on the engine will have no impact on a claim for a defective heated seat or handgrip or some other non-engine related claim. OTOH, if you change the manufacturer's ECU map or the heads or some other engine component WITHOUT their authorization, than they COULD deny a claim for a failed piston, valve or even the entire engine.

And HD has ALWAYS had the right to deny a warranty claim based on changes made to the bike if they believe the failure is related to an unauthorized change you made.

Now whether a dealer will assist you or the MOCO, if a claim is to be made against the warranty, is probably more based on your relationship with the dealership than anything else.

Correct, I should have worded it 'denial of warranty claim' instead of 'void'.

My guess is when you file a warrantee claim, HD will instruct dealers to connect & scan your ECM. I believe this process takes a snapshot or finger print of your ECM, runs some sort of computer algorithm program that checks for a checksum, file size, & perhaps date & time stamp & other differences.

The question is what parameter(s) or bit(s) of data are they going to compare their original factory tune to the original copy that your reflashed back to the ECM. Most computer files copied to another computer are exactly the same.

I think there is probably another area in the ECM that gets permanently changed or set when a modified tune is downloaded and It becomes unreversable.

As previously mentioned, warranty claims being honored HEAVILY depends on your dealership and your relationship there. I've had way too many things I have done covered by warranty by my dealer they could have easily denied legitimately. I am VERY fortunate to have a dealer that will do that.

From the EPA Decree that covers 2017 and later HD motorcycles, Defendant is HD corp:

14. Denial of Warranty.
a. Defendants shall deny all warranty claims for functional defects of powertrain components for any Harley-Davidson vehicle (Model Year 2017 or later) registered in the United States, if any Defendants have any information to show that such vehicle was tuned using a Tuning Product that was not covered by Califorina ARB a ARB Executive Order or otherwise approved by EPA.

b. Defendants shall instruct Harley-Davidson dealers to deny such warranty claims where any Defendant or any Harley-Davidson dealer has any such information. https://www.epa.gov/sites/production...avidson-cd.pdf

My dealer is the same. The general manger takes good care of his customers. But who knows that may change with the government coming down on HD. Either way that is why I split my service work 50/50 between my dealer and an excellent Indie about 10 miles away. Pay more at the dealer but I am OK with that, service is quality at both locations.
