Legal To Pass Traffic On Shoulder in U.S.?

Same in Maryland. There are a few right side passing lanes around, but not many. Even if it was legal, I'd be wary. Too often people want to get out and see what is holding up traffic. I don't want to embed my scoot into somebody's door.

In California lane splitting (filtering) is permissible, not legal and some places like San Diego City will give citations for it. It is not however legal or permissible to use the right or left shoulder unless it is marked in a manner that would allow such use. An example of this would be places I know on the 5 freeway near the 605 interchange where it is marked for use at certain times of the day.

I belive it is legal in deleware.

not only will it get you a ticket, in NC.... but given the trash on the shoulder, a flat is more likey

Ohio says this:
Overtaking and passing upon the right of another vehicle.

(A) The driver of a vehicle may overtake and pass upon the right of another vehicle only under the following conditions:

(1) When the vehicle overtaken is making or about to make a left turn;

(2) Upon a roadway with unobstructed pavement of sufficient width for two or more lines of vehicles moving lawfully in the direction being traveled by the overtaking vehicle.

(B) The driver of a vehicle may overtake and pass another vehicle only under conditions permitting such movement in safety. The movement shall not be made by driving off the roadway.

(C) Except as otherwise provided in this division, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree

Here in Colorado you can use any lane if you are legally intoxicated.

J/K...it'll get you a ticket.

Default passing traffic on shoulder

not legal in AR. dont think it is really safe to do so
