All the stock bolts on my original owner 1991 are Grade 5 (3 marks), even on the shock lower bolts and all engine mounts. Maybe HD covered it's **** by moving up the spec to Grade 8 since the 90's, and still got duped. I'm speaking of all the standard 6 side bolts, not sure about the stock hex head allen grading.

OP I know you don't want to hear this so don't read on.

If a foot comes off of a peg by slipping or the peg breaking off rarely should that cause a bike falling by any rider of average competency. Even more unlikely at the 5-10 mph the OP claims. An average persons reflexes as soon as the peg went south would have lifted their foot within .3 of a second.

I had training and a good number of years in accident reconstruction.

these were forward controls we are talking about? if so i can't see you tipping over due to one breaking . if they were mids it would make a wee bit more sense as there would be more down pressure on the peg. just seems like a hard sell. maybe if your lucky the dealer will take care of you. I still can't imagine you have any lawsuit here. the burden of proof seems to high for any lawyer to take it on. i'm not saying it didn't happen just like you are saying, but if you were reading this about someone else having the same issue wouldn't you admit it sounds a bit fishy?

Look man, I'm not going to turn this into an issue of theoretical bike physics and hypothetical situations. I can't disagree with the post below yours... I don't have a strong case in terms of proving it, and the situation invites a healthy amount of doubt and skepticism. The difference lies in his simply stating what happens raises questions, and you making assertions based on conjectures. While accident reconstruction experience infers a certain ethos, I doubt you reconstructed many accidents over message boards based on vague descriptions of what happened. And without seeing the accident. Or the result of the accident. Or.. well, anything. I picked the bike up and rode it down the block to my home with my foot in the air. I'm not claiming the bike itself was un-ridable or impossible to maintain control of. In fact, had I been cruising, I am certain I would have pulled to a stop. As it stands, I was making a hard right out of a gas station in a residential neighborhood, and it came off in the midst of the turn. Your years of experience probably provide just cause for skepticism and critical thinking, fair point, but average reaction time is not a precursor for proper management during an unexpected emergency that should not have happened in the first place. You've made your point that you believe me to be dishonest and at fault (which the tech will ultimately decide), now it is time for you to move on.

Did/Have you ever used the right side floorboard as a peg to stand on while swinging your left leg over the bike when it was on the jiffy stand?

I don't think he has floorboards, just stock mid-controls. Kenny, post up a couple photos so the peanut gallery can chime in.

I'll snap some photos with my DSLR before having in towed into the shop tonight/tomorrow. Never stood on the peg (stock) when stepping over, even once. That'd be awkward on a 72.

My mistake, I read "like" I stepped through a rotten floorboard.
