Go after the insurance cuz it being in an accident is not good if you ever want to sell.
I would be careful riding if you have health issues cuz sure as sh@t the insurance company will be itching to get vid of you leading a normal healthy life.
Ensure you dont sign a waiver clearing your hands of future injury/pain due to the accident.
