I agree. If it's sold in your state, it has to meet your state requirements. A good example is anything sold in CA has to meet stricter emissions guidelines.

my plate is moved vertically next to the rear tire, its supported through one hole by the chain adjustment bolt. its so covered with dirt you can't make out the bottom 2/3 of it, i havent been stopped yet, but if i do i just wipe it clean.

Sure they can; by producing different versions. Just like HD has bikes outfitted to meet CA (state) emission requirements, HD has to equip bikes sold in FL to meet the FL (state) requirements.

State laws can not supersede (water down or eliminate) Federal laws, but State laws can add additional requirements above and beyond Federal laws.

cHarley speaks the truth...........doesn't matter if it came from the factory that way it's still against the law in the state of Florida.To me the penalties are beyond excessive.Third offense is a 3rd degree felony!...... FELONY!

I still dont understand...if its illegal to have a side mount plate in FL, then Nightsters could not be sold in FL. And last time I checked, a bunch of people on here from FL have the nightster and they are all side-mounted.

If that's the case, they shouldn't sell Nightster in FL state imo.

It is NOT illegal to have a side mount plate in FL. It IS illegal for the plate to be mounted vertically or on a a movable bracket.
