Default mounting a custom oil tank?

as some as u may know im doing my first total rebuild, i bought a 1977 Sportster XLH

i got a oil tank from Bung King and now that i look at the photos i have of my bike i notice that this new tank wont fit (it mounts under the seat instead of the side) theres not enough room because of the battery.

now i have found pictures of bikes with the same tank and it looks like they dont have a battery and was wondering has they do this??

I see a couple options. You could try to fit the battery in front of the rear fender under the oil tank. Or I've seen people put the battery in the oil tank, (if the tank is big enough for the required oil & battery), by cutting an opening out of the top of the tank, then fab up a box (sides, a bottom & a hold down bracket) to slide down in the oil tank....Weld the box top to the oil tank, and pretty much done. From the pictures, it looks like you have enough room in front of the fender or a big enough oil tank to do either, but that's just judging from these pictures.
