I had a problem with mine popping up....and then it didn't wanna stay latcheddown......So I simply hammered it up and down with my finger till it started latching reliably.
There should never be an oil leak only because the cap is popped up....it pops up so you can grip it to turn it, not seal the oil tank.

Probably because it was never closed.
You have to turn it to align it to the oil tank , then push it down.
Now how would I know this ?

I have a question for all who own a sporster. Irecently purchaseda 2006883 Custom and after riding a few times I love it. However, the past two times I've rode it, i've had problem with the oil filler cap. Due to the location (almost directly under the seat) it somehow opens during riding. For those not familiar with this cap, you have to press which pops the cap up then you must turn counterclockwise to remove. When this cap 'pops' to the open position, it allows oil to exit the tank, causing a mess and a creates a huge potential problem.
I was wondering if anyone else has experienced this same problem or have heard of something similar. I was at a HD dealer today and it seems like the 07 and 08 models have a small space between the seat and the oil cap. My seat basically sits right on top of this, which makes me believe something is not right. I bought this bike with only 1100 miles so I can't imagin anything could be seriously wrong with it.

Unlike everybody else apparently, I have experienced the same thing on my '05 883C and '07 883L. I think I have traced the problem to my leg compressing the cap. I am 'height challenged'.
Unless I am careful, I sometimes pop the cap up when I push the ground with my right leg. If I am backing upormoving the bike forward while seated it can happen.

The cap on my 06 1200C has a wide tab and a narrow tab can only go on one way . But maybe the first owner tried to force it on the wrong way. Go with the oil temp cap $45.00 bucks it is made to just turn in not pop up. Now my gas cap is another story it's a pain to get off.

I had heard the biggest PIA was getting it off and back on properly. Well, I had to see, so took it off and checked oil, and put it back on, properly I thought. But it kept popping up. I looked at it and thought this just doesnt look right. When u screw it in, when u think it;s right, just give it another quarter turn clockwise. It's a little tight and hard, but once u do that and snap it down. It will stay there. Never had another problem once I figured it just wasn't all the way in before pushing it down.
