I bought the same bike new in 2010...I thought it seemed a might hot as well... but it had been a while since I had bought a new bike (1991 HD).. I had forgotten how tight a new motor is.. I only got 30 miles to the gallon on the first tank of gas...after a couple more tanks of gas the motor loosened up, cooled down and I was getting 40-45 MPG. Get some seat time on it before you start making changes.

I'm not saying they absolutely won't warrant anything , but I don't see how the MM act can force them to warrant any vehicle that's been modified or altered with "Off Road Use Only" parts that aren't street legal, the warranty is for an OEM vehicle.
MM does cover maintenance performed outside of dealers ,and use of fluids , tires , brake pads , batteries, ect that aren't OEM consumables but meet the OEM specifications . Altering the vehicle with aftermarket parts seems beyond a reasonable expectation of warranty coverage.
2017's a whole new ballgame since Harley got fined and spanked pretty hard by the EPA , for selling and installing Race tuners , exhaust systems , and air cleaners on bikes they knew were going to be used on the street and were not CARB compliant . If it came to it you can bet the MoCo will fight tooth and nail in court , if they cant do it ( there was alot of $$$$ in it for them ) their not going to honor your warranty if you do it. With this vary recent precedent set against Harley , and don't forget VW also , your lawyers gona have to prove why it's legal for you to do it but not the manufacture ,basically overturn the EPA's case against Harley & VW , and beyond that , to also require the MoCo to warranty it.
I'm betting you have a much harder battle than you anticipate.
