My Deuce will only hold a little under 3 quarts which puts it at the full mark. Some don't like to keep it at the full mark but I do with no problems.
I usually put in about 2 & 1/2 quarts & go for about a 4 mile ride, then recheck while oil is hot & add what is needed to bring it to full mark. As said a baster or a 2 oz syringe which can be got at a pharmacy is the trick for removing excess oil.

I think if you read far enough ( not sure it is in there) but I think that 3 1/2 qts is for a dry motor not having run yet. I only get about 2 1/2 qts in it. Then top it off after it's hot again. I keep mine between 1/2 and 3/4 between the marks.

for what it's worth, the books states 3.5 qts. with filter change and 4 qts dry.
I only got 2.5 qts. in.
That leads me to believe that if I had ran the bike before the oil change I would have gotten 1 more qt. up from the from the crankcase leaving only 1/2 qt. of old oil in the crankcase.

Next time I change the oil I follow the correct procedures and see if I in fact get 3.5 qts. in.

I fill the filter - put it on, then add just slightly over 2.5 qts. = good to go.

tip - if you fill the filter right to where the threads start then wait about 30 seconds it soaks into the filter and wont spill out when you screw it on

Turkey baster and I use the oil scavanger. Why anyone wouldn't want a 100% clean oil change I don't understand. Clean oil runs cooler, period. With the oil cooler I have I pump out over a quart of old, dirty, filthy oil everytime I do an oil change. I think I paid 84 bucks for mine but I have seen on here where guys have made their own.

I did my own scavenging for $13.

BTW, as every other 1000 oil threads have stated, draining only nets you about 2.5 quarts. The other quart is in the bottom of the crank and it's corresponding passages.

Sounds like the plan to follow on the next change.

Thanks everyone for all the responses.

Let's now put this one to bed.

Thanks,
