I've never used it with a passenger. Seems if the passenger is not skinny, they would be right on it.

I cut a piece of a leather belt to put between the metel bracket and the pass pillion because it seems it would wear into the seat after a while.

If I had the money I would much prefer the mustang set-up, but as I said, for the cost it's pretty good.
Doesn't help with your '09 fitment question/problem, but as follow-up...

Tonight I rode with wife for the first time with the passenger and the FHC driver backrest. We rode about 85 miles (between bars) She said she did not feel pinched in (she's not real skinny) and she actually liked using the FHC as a hand rest.

The backrests mount onto the stock seats....it works great and is comfortable.

Are the pads on the Firehouse and Grasshopper covered with leather? I got a backrest that looks very much like the Firehouse from a friend that sold his softail, and I like it very much but it is starting to wear some and I noticed it is not leather. I may get it recovered or order another one soon. It fits my 2008 very well. I have been using it about a year now.

No it is not leather, probably just a black vinyl. However, you most likely can replace it with leather.

Firehouse customs is gone.
Grasshopper is ok and hard to beat the price, but I have a few peeves with it.

Many seats/backrests are made from synthetic materials, they will tell you that it is cheaper, more weatherproof, require less care and look identical to leather. That is up to you to decide if they are correct. My Grasshopper looks identical to the leather Heritage seat.
