Default Fat Boy issues

Looking for a little technical assistance on an issue with an 08 Fat Boy. Ok I stop in a local harley dealer yesterday and notice a nice Fat Boy and think that would be a perfect bike for my wife and went the rounds with the sales staff and done the paperwork etc. I go back today and test ride and when I was cruising along around 20 MPH and crack the throttle and it falls on its face and backfires and then starts to accelarate fine and then when I let off it it backfires again. once up to speed "45 or 50" it doesnt fall down when I give it more throttle. The bike does have VH straight shots exhaust on it, I get back to the dealership and let them know about the issue. They commented it could have been do to the weather, it was about 35 outside. But said they would check it out, it almost sounds like it didnt have the download done after the pipes were installed. But I am not sure, so I am seeking the advice of everyone here. The loan papers are filled out and just needs our signatures to take the bike home. The bike has 3000 miles on it not sure if that helps, I would appreciate any advice as I dont want to get it home and it completely goes down.

Don't sign the papers until they get it right and you ride it and are satisfied is my advice.

Ditto the above. Make them make it right BEFORE you sign.

i agree with the doc, and demand some sort of warranty, incase they put a bandaid on the issue to scoot the scooter out the door, i wouldn't be too afraid of it, but would definatly have them correct the issue before i signed on the line, and yea i agree with you, sounds like they didnt put a map to it after the pipe install----good luck

The HD download usually sucks,,, it needs to be dyno tune and in order to do that U need a F/M system.......
