If it happened while riding, it's on you. even if they installed it. They mearly put the part on you wanted, the side effect of you bottoming out is on you.
If they did it while installing the lowering kit, it's on them and make them replace it.
I have a lowering kit ,but haven't put it on. I already drag my pegs and primary when riding hard.

The dealer is going to tell you that the lowering kit is a modification requested by the owner. Then they are going to pull documentation showing that the lowering kit does not fit the FXCW Rocker or Rocker C. Any modifications to the bike that changes the stock configuration IS the responsibility of the owner.
How could this not be the dealer's responsibility to fix? What does putting a lowering kit on a bike (by the dealer) have to do with the seat coming down too hard on the fender (by the dealer too?)? I'm pretty naive I guess. If they happened to be replacing stock shocks would they be responsible if the same thing happens?

I recently tried to order a painted part (COZ) for my Rocker C and was told by the dealer and local parts distributor that painted pieces for the Rocker are obsolete and unavailable from HD. You will have to order the primed piece and pay to have it painted.

Were I the dealer, I would not be using this kit after an issue like this. They do need to take responsibility for what they installed.
