He told me to take some fuel line and secure it to the tire. It keeps the same space between the tire and the fender. After that we should be able to tell better and figure out if its the mount or the fender.

I was thinking that was because of the extra 1 inch between the tire any the top of the fender.

Yeah man, the leading edge of that fender should be lower & closer to the tire.
If you remove the upper bolts and just loosen the lower ones the fender might pivot down into the correct position. Then the fender mounting tabs won't line up w/ the sliders though....

I had already noticed it. Just couldn't get anyone to agree with me that it was off.

I think that fender is built correctly dude, I don't think the radius is off at all.
All you need is to mount that fender lower to the tire. Once it's mounted lower to the tire (by using fuel line to mock it up) you will see the radius of the fender is gonna follow the edge of the rim perfectly. It looks off right now because it's sitting too high off the tire.
This is good news dude, you won't have to send this to anyone to fix it. Just take a dremel and bore out the holes (might turn out to look like ovals) but that doesn't matter.
Bore the holes in a way in which it will allow you to mount the fender closer to the tire. Then, before tightening the fender make sure the leading edge of the fender is the same height off the tire as the bottom edge (work it like a teeter totter). The difference in the mounting tabs in relation to the fork legs will be very minimal.
You can fix this. The dealership might end up making a bigger mess.
