Because his atty seems pretty aggressive and I wonder if a regular Lemon Law atty would be as aggressive as someone's personal atty. And....... if it is a Lemon Law atty, it seems as though this must be pretty much a slam dunk case and could open a lot of doors for others.

Fair enough...

This problem seems so pervasive, and HD's response so underwhelming, it may be some type of class action suit that finally fixes it. And yeah, in that case the type of attorney is pretty important.

I'm still draining primary fluid and adding trans fluid to my bike waiting for some type of "break" in this issue. But a few more months and I'll have to get on the battlefield myself.

When I took my Ultra Limited in to my dealer for its 1k service, I asked them to check the primary before draining to check the level. Sure enough it was high. They called the motor company and parts are being shipped out. I'll schedule the work when the parts are in. So it seems they are recognizing the issue and addressing it as it come up. It may be worth a trip to your dealer to get it fixed under warranty.

He is a normal lawyer. I'm not familiar with the U.S. Law in that respect. In Germany you have to give the dealer a fair chance to solve the issue. Fair means two attempts in an acceptable time frame. And it must be a serious issue. If they can't get it fixed, you can give the bike back minus a deduction for the miles driven. I didn't get a reply yet, but if they want to go to court, they need to prove, that this isn't a serious issue. As I'm not experienced with lawsuits, I don't know either if a court accepts this as a serious issue. We will see.

The lemon law varies state to state, not really a US law completely from what I understand. In Ohio, motorcycles are covered, some states DO NOT cover motorcycles under the lemon law. It don't make sense to me but I did not make the laws. I went to the Ohio Attorney General webpage to view the information. You may want to check your own state for specific information about the law in your state.

Still waiting on spacer to arrive here...........

I drained the primary 200 miles ago at the 5K service interval. The level was at the top of the derby cover opening. My comment was in line with the previous posts that some have needed to add less oil to the tranny over time. I have noticed the same.

If your state doesn't have a Lemon Law I would look at the Federal Magnuson–Moss Warranty Act to see if it can help.
