PostedSaturday, March 31, 2007[/align][/align]WILMINGTON -- A 25-year-old motorcyclist who was clocked at 140 mph before slamming into a Cadillac and killing its backseat passenger in Odessa last year was sentenced Friday to two years and six months probation.
[/align]The first six months of Joel B. Devich's sentence must be served in Plummer Community Corrections Center.
[/align]Devich, who pleaded guilty in January to criminally negligent homicide in connection with the May 21 death of Jane Langshaw, 63, of Wilmington, moved around the courtroom with the aid of a cane.
[/align]Before his sentencing, he said only that he would not ride a motorcycle again.
[/align]According to police, Albert Langshaw was driving a 1992 Cadillac Deville as he pulled out of the Hearth Restaurant on U.S. 13, and was headed south when Devich's motorcycle, a 2006 Kawasaki Ninja, slammed into the car from behind.
[/align]The Kawasaki rolled up onto the roof of the Cadillac, causing it to collapse.
[/align]The motorcycle then rolled off the front of the Cadillac onto the ground, police said.
[/align]Albert Langshaw was not injured, but his wife, Jane, died in the crash.
[/align]Another passenger, Linda Williams, 50, of Tampa, Fla., escaped injury.
[/align]Two other passengers were taken to Christiana Hospital, police said. Nancy Williams, 71, of Tampa, was treated for a concussion, and the Langshaws' 11-year-old granddaughter was treated for back pain.
[/align]Devich was taken to Christiana Hospital with fractures to both legs.

If it was my wife or any family member, he would be asking for life without parol, I would be asking them to let him go because we had a little trip to take.

He did not get two years... he got two years probation! 6 months of jail... that is terrible! Kill someone because you are stupid, you should do more time than that!

That is way too lenient! He just murdered someone. Whether it was with a motorcycle or a gun ... he drove his bike as if it were a weapon. No one driveslike that on a populated roadwithout knowing the consequences.There must have been some sort of plea bargainin this case. That's just nuts!

If I fire my gun straight up into the air while standing in a crowd of people and someone in the crowd is struck and killed by the bullet as it falls, should I expect a six month active jail sentence? Hell no. The fact that I didn't intend for my bullet to kill anyone is irrelevant. I will be held accountable, and judged, for the reasonably foreseeable consequences of my actions. How this is different from someone traveling 140 mph who takes the life of another is beyond me.
