Lawyer up and make sure the lawyer knows about the phone, they can subpoena the records. Sock it to that jerk that hit you. No mercy.

Thanks for keeping us up to date, so good to hear you got out of the hospital and hopefully your wife will be out soon. Get a good lawyer and take the cell phone talking monkey to the cleaners.
