Like how the daughter refuses to take responsibility for her mother's choice, and blames the company for selling the helmet.

I just bought a new one made by Voss for $40.00. Wanted a DOT but just can't get past the size difference. Just got back from a trip to Pa and did not have to wear a helmet in the state. Pisses me off that there are states telling us what we can and can't do. BTW, did not read the article. Just venting about helmets. I HATE WEARING A HELMET!!!!

Because of that helmet, she doesn't have a mother? How about because of her mother's decision to wear that helmet instead of a safer one, she doesn't have a mother? This is where we get all the bullshit nanny laws and waste-of-money lawsuits.

A lawsuit won't hold up, they're sold as a novelty. That alleviates any responsibility of the manufacturer or merchant

"If your going to put a helmet on your head, why not put one on that protects your head?"
Can't say I understand people's logic when it comes to wearing novelty helmets. Kinda like using a novelty parachute because they're cheap at Walmart and it's slim design looks cool or slim design novelty life jacket that only has 3lbs of buoyancy.
In this case I think her fiance is the one with the greatest culpability since as a bike owner he would have known the difference and probably purchased the helmet for her or provided it to her.

Just remember what DA's say: Jury: 12 people not smart enough to get out of jury duty. Oh yeah and Grand Jury, volunteers that have nothing better in life to do.
