Doesn't anyone read the disclaimers on the products they buy?

NOTE:. License plate location and fold-away feature is regulated in many states. Check state and local laws before installation. Fits ’04-later XL models. Will not fit models equipped with rigid mount saddlebags, rigid mount sissy bars, and Turn Signal Relocation Kit P/N 68732-02A and 68733-02A. Chrome.

Also the Fl law says "“The license tag of a motorcycle or moped must be permanently affixed to the vehicle and may not be adjusted or capable of being flipped up. No device for or method of concealing or obscuring the legibility of the license tag of a motorcycle shall be installed or used.”

Is that to hard for anyone to understand? You have a flip up plate bracket, it's capable of concealing or obscuring the tag, and it's illegal. All these self taught internet lawyers need to get a grip on the REAL laws and not what they THINK they are before offering their misguided advice.

did you buy your bike in FL? did it come stock with that plate holder? Was it before or after passage of the FL statue?

Both his listed bikes come stock from the factory with the side mounted plate. If he bought those bikes in NEW FL, from the dealer, doesn't the dealer has some responsibility in assuring that they are selling a bike that meets the state laws?

Modify your bracket to make it "fixed". Sounds like the only issue is the fact that the plate can be flipped. If you make it where the plate cant move you should be fine in the future.

Sucks you had to find out the hard way that a factory piece isnt legal in your state. Good luck with eveything.

Side mounted license plate isn't the issue here. He received an infraction because his license plate was mounted on a fold-able mount. Which by FL statutes, is illegal.

Ignorance to the law isn't a defense. Put a different mount on the bike, pay your fine, and move on.

Doesn't matter if it was folded or not, the wording in the statute is "capable of being folded", therefore, you were in violation.

Also, it doesn't matter where he bought the bike, and what they put on it. As the registered owner and operator of the vehicle, he is responsible for making sure that the vehicle is in compliance with local laws and statutes.

For instance, NY vehicles require front plates, while many states surrounding us do not. If you buy a vehicle in a state that does not require it, it is YOUR responsibility to put the front plate on , not the dealer.

Different situation in that my question is in regards to the responsibility of the licensed dealer to sell a vehicle in the state of sale that meets all requirements peculiar to the state DMV Code. The mount on the bike as delivered from the factory, is FOLDABLE. If the FL statue does not allow that, the dealers in FL should be doing something that makes it NON FOLDABLE. May not completely alleviate the operator's responsibility, but I think that most consumers purchase a vehicle new from a dealer and expect it to meet all the laws of the state it is sold in. For instance, in Texas, where front & rear plates are required, new cars & trucks are sold equipped with the fronth plinth as to facilitate compliance with the law. ...

I've always wondered about the Ultra's license plate, which is pretty much hid under the top case. We talked to some bikers in the Prescott, AZ, area, who told us the "speed camera's" used on some of their area roads are mounted too high to get a clear picture of their plates, so they don't bother to slow down when going past them.

Just wondering, it looks like the law says "flipped up" and unable to be seen. I have the side mount from a Slim on my LO. You cant flip it up or any other way to make it so it can't be seen. Yes it will fold if you hit it, but it springs back to the "normal" postion.

Seems like that would meet the "spirit and intent" of the law. Take it to court, what have you got to lose.

According to what I've read here. The OP had an illegal license plate mount and got a ticket for it. Pay your fine and look over the Florida vehicle code (as it relates to motorcycles) real good to make sure you don't have any other equipment violations.
