Michigan Helmet Law repealed..partially

In the CCCP of WA, the legislators let the Waffen State Patrol write our helmet law in 1994-totally unconstitutional.
I think the objection to cops giving an opinion is exactly because of the job- conflict of interest- the less laws to enforce, the less revenue-follow the money.
I trust your opinion as a rider, and hopefully a LEO that walks the talk when it comes to the oath of office you took to defend the constitution and bill of rights. So many forget or don't care.

But lets not forget there are alot of good people performing a very difficult job.
And I dont't know of any job or career that doesn't have dumb asses. We all have them.

I'm happy the helmet law was finally repealed.
I remember riding to Lansing in '75 for what I think was the first major protest.
I respect the right to choose to wear or not wear a helmet and I think the regulations in regards to age, experience, and insurance are pretty common sense based.
However, not having too much hair left and not too much of a brain, I will still wear a helmet at least 99% of the time because I cannot afford to lose either.
And it does get cold, wet, and sunny here in Michigan and that lid feels pretty good especially at freeway speeds.
Ride safely!

Here in canada it is the law. I do remember when it was ok not to wear a helmet. However I promised my parents I would wear one anyway so they would let me get my license. I am used to it now, some 43 years later. Too cold/wet here anyway. And now that I am bald, it is better than sun block!

$20,000 insurance will not even cover the typical $30,000 cost of a helicopter ride to the ER.
In related news BC has banned beanie helmets (think they mean 1/2 helmets) but may legalize lane spitting (filtering) with the same legislation.

its great that you no longer need to wear a helmet by law. i think some of the requirements are fair, however, that extra 20k you need on your insurance is bull! i can bet that if you were to go down and perhaps DIE... your family will STILL have to take the insurance company to court. anyways... im glad that i would no longer HAVE to slap on a skid-lid to make a run down the street or around the corner. awesome

I have a few opinions:
1. The law wasn't repealed... it was modified. So, that makes it a partial win. The right thing to do would be to repeal the law mandating the helmets in the first place. Therefore, riding without a helmet would not be made legal..... it would simply not be illegal. The difference is, a repeal would not have conditions.
2. The law does not require you to carry proof of medical insurance. Therefore, it is effectively unenforceable.... unless you are stupid. Consider this scenario.... you are pulled over for some alleged violation and you are not wearing a helmet. Cop asks, "do you have the required level of medical insurance?" You say "no". Cop then writes you a ticket. The alternative scenario.... you are pulled over for some alleged violation and you are not wearing a helmet. Cop asks, "do you have the required level of medical insurance?" You say "officer, with all due respect, I refuse to answer that question (and any other questions)". Remember, it is his obligation to prove your guilt. It is NOT your obligation to prove your innocence. Keep in mind... when the cop is asking you questions.... he's not your buddy striking up conversation.... he is gathering evidence to use against you. Don't give it to him.
3. I have lived in at least two different states with no helmet law. However, I always wear helmets. But it is my choice. It offends me that the government thinks they have to choose for me matters involving only my safety. Everyone knows that it is more dangerous to ride without a helmet. But one could also argue it is more dangerous to ride a motorcycle... so are they going to ban bikes? It is dangerous to sky dive... are we going to ban that? F*%k the government that wants to make decision about my personal safety because it considers me incompetent!!!
Bottom line.... a partial win is a win. Good on ya, Michigan!!
And by the way.... it absolutely IS a matter of freedom!!!!

All I gotta say is this, after feeling my helmet hit the pavement with my head inside, I am still alive to tell the story. I will never ride without a helmet.
It really doesn't matter how long you've been riding. You don't have control over that idiot that comes over on you on the freeway or the moron that pulls out without stopping or the twit on the cellphone running a red light, it only takes one time and you can be either dead or in a state where someone else will be changing your diapers for the rest of your days. Not my idea of a good time.
Wear your helmet.
