Default Passing speeds

Some states require passing speed to be the posted limit, others allow to pass as quickly as necessary to get out of the opposing traffic lane, speed be damned. Whats the law in your state. I've also noticed more two lane secondary roads are striped with double no passing lines for miles until a passing lane is provided, in the past solid double lines were only used in corners and hills you could not see beyond.

I'm pretty sure Ohio is what's posted, nothing faster than the posted limit is legal.

Correct on the Ohio thing. Posted limit is the posted limit. Of course with my dyslexia my brain thinks thats a 95... so... Im good with it

Most states have adopted the speed limit language from the Uniform Vehicle Code, which sets absolute limits. That means exceeding the speed limit is illegal per se regardless of whether or not it is safe. These states are marked " A " in this list:

Most law enforcement officers that posses a lick of common sense understand passing speeds when overtaking a slower vehicle. The less time you spend in the oncoming lane the safer the pass. A factor that will get you a ticket is if the vehicle you were passing was doing the speed limit.

These days they have planes, helicopters, over head drones, cell phone tracking and tracking devices installed in the vehicle. Rental companies have been know to call the police and tell them you are speeding and where you are at.

You can exceed the speed limit (a little bit) in my state, I'm okay with that. If a cop pulls you over just tell them I said it was okay.

I don't believe any state would say it is Ok to exceed their speed limit in order to pass or anything else. Think of it, all you would have to do is stay in the opposing traffic lane and say you are passing and drive 120 mph. There is always a car behind or in front of you so you would be passing or about to pass!
It is most certaintly up to the cops discretion as to when he writes a ticket, but no law will be written saying it is Ok to break the law.
