I was knocked off my 883 eight months ago by a 17 year old who "Failed to Yield Right Of Way". Perpetrator was ticketed, his insurance has accepted full responsibility. My bike was "Totaled" but I am fully recovered except for a few small scars. The lawyer I talked to advised me not to settle for anything less than full replacement costs for the bike plus 2 times Medical if they pay the medical or 3 times medical if I pay the medical assuming I have No Permanent Injuries. Your dad has a permanent injury, he should get more.

This advice was contingent on my Not needing to pursue the settlement in court. If it becomes necessary for me to sue for a fair settlement, lawyer fees will inflate the amount I should expect to recover. The lawyer I consulted typicly gets 33% of the settlement if the responsibility for the accident is not contested, as is true for my circumstance.

My father was able to contact a lawyer which offered pretty resonable fees, since the insurance company offer 21k anything additional that he receives in court the lawyers is going to charge 23%. And of course I am still trying to discuss with him options for different doctors, hopefully we can find a good doctor that will be able to help his hand, or at least ease the pain as much as possible.

Its normal to low ball if U don't have a lawyer.
My mother was offered 20k for the loss of use of her right hand.

After we got a lawyer it went to 180K fairly quick..

so pay the lawyer his 33% and Ull still come out ahead.

A lawyer who takes a personal injury contingent-fee case puts his money at risk up front, so you risk nothing. For him to take the case, there has to be enough potential to recover what he pays up front, plus a profit for him and for you. Having a guy pay his own money up front at no risk to you seems like a pretty nice benefit - bet you won't find many businesses doing that.

Lawyers practive law for a living. I don't hear anybody badmouthing carpenters because they won't come out build you a free house and pay for the materials when you can't afford one.

Seems like a pretty good deal. Normally it's 33% of everything and you pay for expenses (filing fees, depositions, copies, experts, etc.).

Find an orthopedic surgeon who specializes in hand surgery at one of the local or nearby University hospitals. UT, Vanderbilt maybe ?. A 2nd opinion is always inexpensive. I broke most of my fingers in a motorcycle wreck and got them all straightened out by a specialist. Best of luck.

We did get a second opinion after his sugery because it was not any better. The second opinion said that there was nothing they could do, supposedly that was supposed to be the best doctor in the area here. The problem we are having is because someone else had done surgery on him, no one else wants to take him. Which I can sort of understand in the sense that if something happens as a result of his surgery while he is working with another doctor, perhaps the doctor he was currently with would be held liable. I'm not sure if that would be true or not I'm just speculating that may be the reason.

T-Boned by commercial vehicle caught on cop dash cam, unlicensed driver, was involved in 4 other at fault accidents in California two of which involved bikes! Low back fusion, shoulder rebuild, wrist fusion, busted fuel line in my melon!! Bike totaled! Insurance offer withen 36hrs, replacement bike + $30,000 prior to knowing extent of injuries! Refused offer got attorney, all doctors were willing to got to court, cop video was an asset, wore helmet during scooter safety month got TV time, got max insurance amount, got personal assets of driver! Attorney made >$800,000
My family and I were very happy we did not take the first 7 offers! Good luck buddy...

Hell no! Their 33% ended up being 44%.
One thing I did learn from them is you can only get what they have coverage for. In my case the guy had a collision policy of 25k. So thats all "we"(my wonderful attorney and I) could get. You can sue, but them you forfite the insurance money, and if its abig enough lawsuit they will just claim bankruptcy. If you have under insured coverage you can apply for that money as well. The best thing my ***..er attorney did was lower my medical bills by over half. Another thing is attorneys get 1/3 of the money BEFORE anyone else gets their hands on it. And they charge you for everything, phone calls, paper, paper clips, toilet paper etc.... Sorry for the rant, still bitter with those guys.
