On an air cooled engine I would not accept that motor after being run out of oil. You can easly have internal engine damage that isn't noticable at this point but will fail once they wash their hands of you & your bike.
I would tell them that I want a new crate motor with new numbers proving it is different. They own the oil starved one!
& now tell them that you want a loaner so you can get a few miles in before winter!
Hatch.

I learned about checking the oil before you leave almost the hard way, I did not much like the kid they had doing my service and suspected he did not know what he was doing and made sure to check it when they said I could go. Both the oil and the tranny were not even on the dipstick. Glad I did not take off. Let us know what the shop does, I would almost want a another new engine I believe. At the very least make them give you a 50 k warranty on it for wear items that the oil lubes.

Default update....

Saturday when I went to the shop to talk to the owner (Junior) about this little issue, he assured me he would " take care of this and make it right". The service manager (Mike) called me later to see if the bike was picked up yet and he stated " we will take care of this.. don't worry" I said to him "as long as taking care of it includes pulling that motor and putting in a new one" he replyed " oh absolutly, we are going to replace that motor, of course..." Today, however, "The ball check on the oil pump was stuck so all the oil had drained into the crankcase but we checked it out and fixed the pump, tomorrow we are going to ride it for about 50 miles just to make sure there are no issues". Tomorrow I call my attorney!

By the way, the name of the place screwing me is Lifestyle Cycles on State College Blvd in
Anaheim,Ca I highly recommend you avoid this place.

""The ball check on the oil pump was stuck so all the oil had drained into the crankcase but we checked it out and fixed the pump"

BS, some idiot that works there didn't fill it with engine with oil, it happens all the time at those quick lube places.

honestly you could've done this work yourself and saved a ton of cash and done a much better job.

Years ago I picked up my new Ford Econoline at the dealers. They gave me the tour of the shop, introduced me to the Service Manager etc. While I'm shaking the guys hand some customer comes rushing in pissed.....they forgot to put new oil back in his car after the guy started driving home. The Service Manager says "hey, relax this happens sometimes" to the guy and right in front of me...UNFREAKIN believable
