Default I am totally pi$$ed!

I posted on May 6th that "it finally happened." I was rear ended by a gal while I was stopped at a stoplight. Seemed like she was distracted, probably texting or something, looked up saw the light was green and stepped on the gas. Only problem was I hadn't moved yet. She caused $1860.00 damage to my bike, to the rear fender, etc. She jumped out of the car saying she was sorry and had full coverage with Geico. Turns out it was her grandmother's car and it was insured with Farmers.

I had conversations with the Farmers adjustor, and when he told me that she claimed I backed into her, I laughed. He chuckled too and said "I know." Well today I get a letter from Farmers denying the claim because I backed into her. So I called the Farmers supervisor and he claimed it wasn't unheard of that a bike would back into someone on an incline and cause damage. I guess I must have forgotten to take my bike out of reverse right? So now I have to sue the b tch in small claims court.





I guess what I should have done was to drop my bike, fall on the ground crying about whip lash and all that stuff! Seriously I probably should have claimed some kind of injury so that the police would have come out to make a report. Damn! Tired of lying pos drivers!

Hindsight is 20/20, but shoulda had the po-po come anyway, injury or not.

Only problem is that the police will not respond to non injury accidents here in the SF Bay area at least, not sure about other areas of CA though. That's why I didn't call them.

You don't need to sue.

Put a claim in on your insurance and they will subrogate against hers.

I did put a claim on my policy. They paid, less the deductible, no medical. So far I am out my deductible and inconvenience, etc. My insurance, Progressive, now puts in for an arbitration so that they can be paid for the entire claim, hopefully my deductible too but I doubt it.

That sucks that the police won't come. Hell, I have to respond to all little piddly crashes even in parking lots!

Yeah, hat...

I got rear ended (my cage) and called my insurance company looking for advice.
They took over and the only thing it cost me was the fuel I had to replace in the rental vehicle.

Your insurance company is there to help...

EDIT - It took me too long to post and I see you've already gone through your ins co...

That's pretty disgusting of that young lady to change her story, but I am glad you are OK, and that the insurance company is going to bat for you.

What a b!tch. Can't believe some people don't just own up to what they've done and be honest. Actually I can believe it, but still irritates the **** out of me.

I've found that words like "lawyer" move things along rather quickly, even if you have no intent to use one.
