Yes - all they need is probable cause. In fact, in KY, DUI is one of the few misdemeanors that don't have to be committed in a cop's presence to allow a warrantless arrest. All they need is probable cause to believe that you have been in control of a motor vehicle with a blood alcohol over .08%. Conviction might be hard, but that cdepends mainly on how you look to a jury, if you and the prosecutor both decide to go to trial.
We have a different charge for skateboards and such, called "DUI on a Non-Motor Vehicle." I have only arrested one person for it, years ago, after he rode his bike in front of my car at about 3 am.

Well alot of beer, guys that ride and bikes around-something is going to go down every time LOL! Well gald you did not get busted and next time maybe have the burn out contest the next day. Oh well we all do dumb stuff at times and as long as we live to tell about it, it makes a cool story.

Never heard the old "private property/illegal arrest" BS from somebody claiming to be a police officer. Usually it's some drunk in his front yard, so I'd always tell him I'm going to let a judge explain the law to him. Arresting somebody for DUI on private property, without witnessing the DUI is definitely legal here and, I believe, in most states, since it came from model laws being passed in the 80's/90's across the country.
We aren't talking about "In General" tho. We were talking about THIS instance, where a guy did a burn out in his garage. You didn't witness a traffic infraction. The caller most likely doesn't know who was the vehicle operator. You can rest assured that there will be No Witnesses to the event.
So who do you arrest for DUI? Just anybody who happens to be standing around?

Hhaha. I am a County Jail po-po. That don't matter much here in the city. City cops don't give a shiz if you wear a badge unless it's one of theirs. I would have definitely gotten a ticket if they would have showed.
