Conviction might be hard, but that cdepends mainly on how you look to a jury, if you and the prosecutor both decide to go to trial.

We have a different charge for skateboards and such, called "DUI on a Non-Motor Vehicle." I have only arrested one person for it, years ago, after he rode his bike in front of my car at about 3 am.
Brenn, thanks for the response. Didn't meant to stoke the fire, but I had to ask.

Yep. and they are just going to get meaner. I will be moving to Oklahoma sometime in the next year and will be having them as often as I can physically stand.

I agree with you to a point: I have made private property DUI arrests w/o actually witnessing the guy driving.

We aren't talking about "In General" tho. We were talking about THIS instance, where a guy did a burn out in his garage. You didn't witness a traffic infraction. The caller most likely doesn't know who was the vehicle operator. You can rest assured that there will be No Witnesses to the event.

So who do you arrest for DUI? Just anybody who happens to be standing around?

I would have invited my neighbors, but they are all over 70, rich, and don't like me already, LOL.
Sounds like the City Police and City Firefighters where I live. They go outa their way to harrass each other. Makes for some good basketball and baseball games though. lol.
