Like the rest glad your okay---sounds like you didn't expect it to happen. I never quit watching my mirrors and I watch them close whenever someone is coming up behind me. I have had to get out of the way twice to keep from getting hit from behind. If I hadn't been watching my mirrors I would have been nailed. Spacing and vigilance is better then a broken back any day.

......One interesting item of note - as LEO was writing accident report he asked me if I was wearing my helmet when accident happened - I said no and then had to explain the helmet law in Texas to him - he was clueless regarding Texas helmet law and unaware of September 2009 updates.
Glad you're OK.
My understanding is that motorcycle accident investigation requires the "wearing a helmet", or "not wearing a helmet" box be checked. These statistics are felt to be important for NHTSA, insurance companies, etc. So if you told the officer you're OK except that your neck hurts a little, it'll be interpeted by NHTSA that "there was a rider injured not wearing a helmet". Even if the additional weight from a helmet would have caused *more* of a neck injury.
(Seatbelt statistics are accumulated this way also.)

Probably not a bad idea to retain a lawyer anyway.
You can always alter your plans in the future, but IMO it's unwise to make plans based on speculation and guessing. The guy may have a trust fund. You don't know anything about him, his financial situation, or his issues. You only know he smacked into you - apparently while he was sick...might also have been on serious medication.
Glad to hear that your injuries at the moment are minor. The bike can be replaced, but you can't - so glad you are still with us.
