In north carolina, the law is 70% of value to total. My estimating program is set at 60% so that i will know it is getting close. I will total anything at or around 60% to take in account any hidden damage.
Some states have laws mandating what percentage of damage constitutes a total loss. In states which do not, the insurance company decides. My insurance company says 75%. I pleaded with them to total mine but they wouldn't. If I hadn't just had my radio replaced under the extended warranty I could have pinned it not workin on the collision. That would have been enough to put it over the total loss threshold.
Also, they also will not allow the owner to retain possesion of a totaled vehicle unless it is 10 years old or older.

I don't know what their reasoning is on that. As long as both parties negotiate and are happy with the results, why should it matter. I'm sure it has something to do with money. They wouldn't want someone coming out smelling like a better rose than themselves.
