Hello all. I want to start off by saying that I've been reading the forums for a while but never really had any questions or thoughts until now...(I'll apologize upfront for the lengthly post)

I get home from work to find a letter from my neighbor saying that her leg "inadvertenly" touched the exhaust on my "uncovered" bike causing a second degree burn while getting out of her husband's SUV. And now she wants to file a claim against my insurance. Now here are the kickers:

First, my motorcycle is never uncovered. Ever. I live in a condo/townhome community and we do not have garages or covered spaces. So, when I'm not on the bike, it's under cover.

Second, she mentions that the bike isn't in a designated spot. Which is true but the spot that I keep it in is in between two diagonal spaces (kind of hard to explain, but let's just say this: she would have had to go out of her way to even come close to my bike).

Third, she says this happened on Monday July 5th (today being the 14th). I didn't ride the bike at all on Monday so there is no way the exhaust would've been hot enough to cause a 2nd degree burn.

Lastly, I don't get to ride a lot. I manage a car dealership and I have a company car. My car has to be with me whenever I'm at work. Which is at least 60hrs/week. At a minimum. I've been keeping my bike in the same spot since March so it's not like my neighbors have never seen it before.

I called Progressive and they'll be sending a claims adjuster to my house in the morning to figure out what's what. Have any of you ever heard of this before? The representative from Progressive said it was the most ridiculous thing she's ever heard of. Can I be held accountable for this? What if she had burned her leg on my bike if it was parked at the mall?

I have a 2010 Fatboy Lo with Vance and Hines Big Radius 2-into-2. It that helps at all.

Any thoughts/suggestions? Thanks for all your help.

Its a 2010? Oh No they run very hot wow Im sure that hurt lol. The joke aside I must say this is 100% bullshit............ I hope she gets nothing! sounds to me shes just looking for a fast buck good luck!

Any residue on the pipes from where she supposedly burned her leg? What part of her leg did she burn, the inside like what would happen getting off of a bike with bare leg exposed? Maybe she burned it on a friend's bike but thinks she can get some insurance cash out of your company so she doesn't hurt her friend by filing a claim against theirs? Sounds like BS if if your bike wasn't even ridden the day she's claiming.

sorry to say your shi* out of luck unless you can prove your bike was not ridden that day your ins will pay, because your bike is in a common area if it was your home, and she came over univited different story but you live in a common area where everyone has access, they will pay her med plus some pain just to make it go away. i would think that would be your home owners ins not your bike ins

I called Progressive just so they can put something on file in case she tries to go after me further. They have an office close to my house and they said they'll send someone out so they can see where it's parked in relation to the other spaces.

There wasn't anything that I saw on my exhaust. Then again, I wasn't looking. I haven't talked to her yet. I want to get everything on my end tightened up before I talk to her. I just got the letter tonight when I walked in the door.

I rode it on the 4th. I was gone pretty much all day. I didn't get home until 11pm that night. I wasn't able to take it out again until this past Sunday.

Now, every once in a while there is a guy that has a Dyna that parks on the other side of the lot. His bike is never covered but he's also not here all the time either. But, It's kind of hard to confuse the two. Especially since my bike is black denim, always under cover and his is silver. Who knows. This is absolutely insane.

I can definitely prove that I didn't ride to work that day. I have 15 of my employees that will back it up.

No homeowners insurance since I rent.

Dang how did she get the door open if she got out and burnt her leg,I mean she would almost have to put her leg down right nxt to the pipe,let alone getting the door open being that close.........

I just walked out there and looked at the distance between my exhaust and the line, it's at least 6 feet.

It would have had to leave a pretty good mark on the pipes! Catching this on video I would get the pipes nice and hot, slap a piece of steak on there to demonstrate what sort of evidence a skin burn leaves behind on pipes. Then I would counter sue her for the pipes you had to damage in order to prove your point. I dunno....I'm from Canada and know nothing about lawsuits and such as they are so rare up here. Just a thought.
