I had one before my V-rod. Fast and comfortable. The gearbox was not needed, just twist the grip in any gear and things happened. You would have to put $10,000 in a harley just to get a wiff of it's exhaust. Will say my friends felt it was fugly! Rolling burn-outs were intoxicating.

Any manufacturer "can" do it. It's a copyright issue. If you own the copyright, you can distribute the thing any way you like. Including for free. It's a business decision. I guess it's kinda like, "when you're the other woman, you try harder."
