You always have the right to ask him to call the shift supervisor.

 

How long was the officer dealing with you? I don't remember the case but it was landmark and any traffic/dui laywer would know it by heart....in the case it was determined that you can't be detained for an extended period unless cause for investigation is present. So, if he pulled you over for that and detained you more than about 20 min (as determined reasonable by court), add that to the aforementioned list of reasons it should be tossed. Granted, if it was 22 minutes, not worth mentioning. If it was 40 minutes, or if you (as a reasonable person) felt his instructions meant you could not leave for that hour you were there, ask an attorney so you can look it up.

 

I typed a letter and gave it to the shift supervisor yesterday and he is suppose to give to the officer's supervisor and have him call me about it. The shift supervisor was nice and polite and did tell me that the officer isnt normally on patrol but because of the holiday weekend he had to do some street patrol. I guess that explains why he was in such a cranky mood. The other friend that was with me also went to complain yesterday and I think he is going to do the formal complaint route against the officer. What does the formal complaint do different then just typing a letter like I did ? The third guy and his wife are going to go put a complaint in on thursday also. I guess I should hear from the officers supervisor some time today.

 

It's hard to imagine all the things you would be leaving yourself open to today if you were a police officer. I don't know if walking on water would be good enough.

 

Man, tell me where this happened. That butthead is going to be looking for a little payback if he got dressed down by his sup. and I would have no problem avoiding his area for awhile. You got the wrong Md trooper on the wrong day. Most of them aren't that gung ho although some can be quite arrogant. He obviously had a bug up his A$$.

 

Not to pi$$ off anyone but I think if the Police Officer stopped you for not having an approved DOT helmet he had two options. First let you go and not give you a ticket. Second, if he gave you a summons for the helmet and he let you go he would be liable if you were involved in an accident and received a injury as result of not wearing an approved helmet.

 

Brucest, Not I am not mad at all about the comment nor do I debate the officers decision. I do disagree about how we were treated and left on side of highway. He wouldnt even escort us to the closest exit to get us off the highway. He was very arrogant and unprofessional. Like I said before if we were doing something crazy or speeding to get the officers attention this thread wouldnt even had been posted we would have deserved it. But to be driving down the road at posted speed limit and to be pulled over for that form an officer driving in oppisite direction I think was odd not wrong just odd. That is why I wanted to see if any others have been stopped for a helmet violation. Thanks and no offense taken I understand exactly what you are saying.
