first of all using a pipe is chicken chit and cowardly, these thugs need to be prosecuted to the full extent of the laws they broke, get a lawyer and have him apply preasure on everyone involved, you and your family will never feel safe again if you do not make a stand now, hopefully with all the bragging they have done you will be able to get good witnesses to come forward and help put these a holes away, because they will definetly hurt more kids in the future.

1st - legal action with the police and Attorneys, etc.
2nd - Italian style brother...let things cool down and let them get comfy that all is clear and calm then???
P.S. Thats not a slam on italians...I'm italian and thats how I would do it.

I worry about my boy first...

Then make absolutely sure he was no way at fault...

Then I would file the necessary stuff with the police & inform the school...

THEN...I would just happen to run in to the parents (or the 18 year old) at the local gas station or Wal Mart parking lot. I would use that opportunity to very politely tell then that if anything else happens to your kid...in regards to retalliation...that they better be able to do some of that 'Neo' dodging bullets **** like in The Matrix.

EDIT - Well, I looked back thru and read that you are from Chicago...It's times like this that Mayor Daly's "no firearms" stance is a kick in the ***...It would suck if these idiots decided they wanted to come on your property and try to retaliate...and you have no right to bear arms. I'd move.

In Texas a 'Restraining Order' isnt worth the paper its written on as an enforcement tool. I as LEO cannot enforce it. The kid could be standing on your front porch and I couldnt do anything about it in regards to the order. It is enforceable as Contempt of Court thru the court that issued it.

A Protective Order is enforceable as Violation of Protective Order thru the Penal Code. I CAN enforce that.

Tough situation. Youve gotten ome good advice about civil actions, notifying the schools and such, and finally getting medieval on them if it comes to that.

Watch yourself and grow eyes in the back of your head for a while.

Default retaliation

Without the slightest bit of hesitation as soon as I heard of it I would have beat both brothers and their dad until the police got there.

You are lucky your son was only hurt as bad as he was.

My sister used to work with a lady who's son was in a similar fight, at a teenage drinking party, he got hit in the head with a pipe, and was killed. They kept him alive on life support long enough to harvest his organs for donations.

So while you are pissed about going after these brothers, (as you should), you should also be grateful your son is good to go, only plus some new titanium and screws and bolts.

Also, are the cops issuing a warrant for the brothers? If so, can the cops just arrest the brothers when they come to school?

You know, scumbags like this are usually cowards when alone. Catch them alone and have a very serious talk with each one individually. Then get some friends together and have the same talk with them together. That way they get the message alone and together. Make sure they understand that if anything happens to your son, whether they are involved or not, they will pay. These first talks do not necessarily involved any physical activity. You have to make sure that they understand that they can not get their relatives to retaliate for them and they can not retaliate on their own. Cause either way the next conversation will involve severe physical activity for them.

Oh by the way be sure to get a protective order against them as evidence of your concerns for you and your family. Make sure the protective order applies not only to your son but to your whole family. They may be scumbags but that does not mean they are stupid.

Too bad you can't just go over there with the whole neighborhood and give their whole family a beat down. Torch their house and make em move the f' away for good.

heh, na don't do that
but if it was legally ok ..then hell yeah

Na I would keep on pressing the issue with law enforcement, attorney and school..and anyone else. Don't let a day go by without some actual progress on what should happen... and take lots of pictures... account for everything your son is going through because of his injuries, account how much time you spend thinking about it all day and the amount of actual time you try to get the system working for you.. even sleep lost... write all this down... keep pictures... then sue the chit out of em..and throw em in prison.
