Yes it's true that you have a case but where will litigation get you? Absolutely nowhere. The only one who will end up with the bike is the guy he sold it to on the way to you and the only ones to end up with money are the lawyers. If you got your cash back, good for you. Count your blessings and move on. If you never gave him cash then there really was no contract and if he kept your cash - you are an idiot for not leaving with the bike.
