Default Florida Ape Hanger Law

So Im going to Florida next month with my Fatboy. I will be getting my 16" Flyin apes in this week, and I was wondering what the law down there was, and how strict they are.. Should I wait till I get back to put them on, or will I be ok.. Thanks..

I don't know what the law is but I see people running crazy high apes all over the place

I don't know the actual law, either, but I wouldn't worry about it. You will see a lot of apehangers.

FL law is no more than shoulder high, but I wouldn't worry about it unless you give LEO a reason to pop you.

Default According to the Florida Statutes:

Just pulled out Vol 2 of the Florida Statutes at my desk here:

Section 316.2095 says (in pertinent part) (that's lawyer speak):

(2) No person shall operate any motocycle with handlebars or with hadgrips that are higher than the top of the shoulders of the person operating the motocycle while properly seated upon the motorcycle.

That being said, I've seen many, many much higher.

if you ride in Daytona you will be pulled.
Anywhere else maybe yes maybe no.

Once you are pulled, expect to be run thoroughly in Daytona, anywhere else if you've been drinking , expect to be arrested.

If you ride with no helmet in Daytona and get pulled for any reason, expect to show proof of $10k medical insurance and a MC endorsement.

Why give anyone the slightest reason to pull you and question you ?

Most all budgets have been cut, especially police departments,
the difference with them is they can suplement their budget using your wallet.

I'm just sayin ..... Enjoy your vacation

I don't know..........I lived in Daytona for over 3 years and never got stopped yet....for anything.Tons of bikes here with ape hangers.They're not too bad most of the year..........bikeweek they get a little crazy handing out tickets but if you're not riding like an idiot or attracting attention to yourself you probably won't have any problems..........Just make sure your license plate is horizontal

If I think I might have a chance of getting pulled over 'cause of my ape hangers I sit up a little straighter and come off the seat a little.Alot of guys keep the clamp bolts a little loose so they can pull the bars back some........I don't like that idea

The above the shoulder rule is pretty typical. Many states have it... kind of makes sense if you're riding further than the bar... your arms will loose blood, and go numb, eventually... that's just biology.

It also means that your bike may be legal for you (or close enough not to be noticed) and illegal for your wife to ride, since your shoulders would be higher. 16" can be all over the place depending on your riser and how tall you are.
